I need to vent so what a better place than my favourite forum. It's Saturday night, got some people over for a get together. About 2:30am now and 5 of us are just sitting around in the basement talking about every day sh!t, when my alarm key goes off. My girlfriend and I learned our lesson when our DSM was hit and run in a plaza parking lot last winter. Anywho, we run outside and all I see is an IS250, parked on what I thought was a driveway infront of my vehicle. I thought at first that maybe it was their fart can exhaust that set it off. I was parked on the street. All of a sudden I hear "Oh my God!!" I come out further to see that the IS250 had actually crashed into a tree head on. I raced to the two people, a girl and guy to make sure they were okay. The first thing she said to me was "I was telling my friend an emotional story and lost control. I'm so sorry, I'll pay for everything!!!!" Me: "..........what?" I turn back to see my entire rear quarter panel and wheel smashed in. Long story short, not only were they both drinking, but the driver, 22 female, blew way over the limit. She offered me 2gs to not involve the cops. I said no way, and obviously called the police. As of right now it's not looking good, and given the black book value of a 1998 Talon TSI AWD, her insurance may look to lowball me in a write off. Cars can be fixed, but man does this hurt. I had the car parked for 3 weeks waiting on my damn rear strut mounts. I just put the car back on the road last Monday!!! Not only was she intoxicated but the tow truck driver informed me the next day that he found weed all in the cup holders. So pissed... Thanks for letting me vent Here are the pics though:

Good thing that you called the cops though, she needs to learn, "emotional story" probably just finished smoking a J and laughing about how high they are while driving home.

That's horrible, too bad she'll just get a slap on the wrist and next time she'll kill someone. The drunk driver who killed my friends Dad had 4 previous DUI's and a suspended license. Not anymore Cody, our new laws will get her some pretty serious sentence. Mike, wow. That just sucks man. If they don't write it off, your car will never feel the same again. If they do write it off, buy it back and fix it. Looks like some rear suspension and body work to me, as long as the frame isn't bent.

Wow. Sorry to hear that, Mike, and I wish you luck with the insurance/repairs/etc. Glad to hear you called the police. I must say though, when I saw that IS250, I thought your car would have been much worse.

Lock her up and throw away the key... I agree, there is no excuse for drunk driving. And even though I am sad to see a DSM get damaged, that could have been some person on the side of the street, she could have killed someone. I think she should do 1 year in jail for this.

This similar siuation could and probably did happen somewhere in Oakville tonight... This kind of stuff happens all the time, and whether or not I think she should go to jail, there is no way she will and certainly not for a year.

When is someone going to actually do something about this BS, this problem has been around since cars, and only seems to be getting worse. She's probably at home in her parents mansion explaining how she's the victim. Should have taken the 2g's, a BJ and then stuffed her down a drain.

Kind of an erie considence that the day after I read your post, a female ran over a worker in edmonton, pinning him between her car and his service truck, he succumbed to injuries. Police suspect drug and alcohol played a factor. Stupidity

from speaking to some insurance brokers, they will offer you an average market value. should be somewhat higher than book value. use ebay as a source for prices. buy it back if you can.
if you decide to part it out, I can chop it for you. i have a place, and i can do it quickly.

Drinking and driving also seem to be more common here then it did when I was in Ontario.

Well personally, since i wasnt part of the accident at all and theres no physical casualties (except hers and her friends), i would take the car repaired at her own expense.
I'll just hit her where it hurts - her insurance.
Really, what else would you sue for? Unless her insurance was dicking you around and/or you think the settlement wasn't fair, i see no point in suing her or her company.
I almost forgot what 2nd and reverse gear feels like.

Yeah I dont mind if the rim is fixed. Its worth like $150 anyway, not that big of a deal, but I dont think they included that in the quote though. It's more the lip that was rashed up a bit. I'm thinking they could smooth it out. On a side note, maybe now's the time to get all my little dings and scratches fixed, lol Exactly, just look at the brightside!

There are wordings and "situations" in place that determine at fault scenarios and rating charts in regards to accidents...
this would be 100% NOT AT FAULT, and placed under a different type of collision section on your policy for people who damage your car that you are witnessed to seeing them while your car is sitting still.
Grant is probably more knowledgeable in those regards, since I'm very very new to the industry and haven't encountered that scenario yet. (best way for myself to learn)
If I were you, the only complaint I would make is the fact she hit it dead on that wheel, once you have "damage" there to that section of a car, it will NEVER be the same. An ex has her car hit there and it spun her around a full 360, and the car was never ever the same again.
I'm glad your content with your settlement they offered because no matter what people say its all how you feel in the end of a claim.

IMO that rim is easily fixable. I've seen WAY worse (like, chunks of the lip MISSING) come back from our rim shop looking brand new. Those guys can do some amazing things with metal. Edit: This is is the kind of stuff i'm talking about. Just look at the before and after. Your wheel would be a snap.
